END USER LICENSE AGREEMENT

PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THE BareClaw AGENT PLATFORM ("SERVICE"). BY CLICKING "I ACCEPT" OR BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
1. ACCEPTANCE OF TERMS
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not use the Service.
2. DESCRIPTION OF SERVICE
The Service is an AI-powered career coaching platform that provides job search assistance, resume guidance, interview preparation, and related career services. The Service is provided on an "as is" and "as available" basis.
3. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
4. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BareClaw, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(a) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE;
(b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
(c) ANY CONTENT OBTAINED FROM THE SERVICE;
(d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
(e) ANY CAREER ADVICE, JOB RECOMMENDATIONS, OR AI-GENERATED CONTENT PROVIDED BY THE SERVICE;
(f) ANY EMPLOYMENT DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
5. AI-GENERATED CONTENT
The Service uses artificial intelligence to generate career advice, draft communications, and provide recommendations. You acknowledge that:
(a) AI-generated content may contain errors, inaccuracies, or biases;
(b) You are solely responsible for reviewing and verifying all AI-generated content before use;
(c) We do not guarantee the accuracy, completeness, or suitability of any AI-generated content;
(d) AI-generated content does not constitute professional career counseling, legal advice, or employment guarantees.
6. EMAIL AND COMMUNICATIONS
If you use the Service's email features, you acknowledge that:
(a) You are solely responsible for the content of emails sent through the Service;
(b) We are not responsible for any consequences arising from emails sent on your behalf;
(c) You will comply with all applicable laws regarding electronic communications, including anti-spam regulations.
7. USER RESPONSIBILITIES
You agree to:
(a) Provide accurate and complete information;
(b) Maintain the security of your account credentials;
(c) Use the Service only for lawful purposes;
(d) Not attempt to gain unauthorized access to the Service or its systems;
(e) Review all AI-generated content before sending or publishing.
8. DATA AND PRIVACY
Your use of the Service is subject to our data handling practices. We may collect, store, and process personal information including career history, job preferences, and communications. You consent to such processing and represent that all data you provide is accurate.
9. INTELLECTUAL PROPERTY
The Service and its original content, features, and functionality are owned by BareClaw and are protected by applicable intellectual property laws. Content you create using the Service remains yours, but you grant us a license to process it as needed to provide the Service.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless BareClaw and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of this Agreement.
11. TERMINATION
We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including breach of this Agreement. Upon termination, your right to use the Service will immediately cease.
12. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
13. CHANGES TO THIS AGREEMENT
We reserve the right to modify this Agreement at any time. We will provide notice of material changes. Your continued use of the Service after changes constitutes acceptance of the modified Agreement.
14. SEVERABILITY
If any provision of this Agreement is held to be unenforceable, the remaining provisions will remain in full force and effect.
15. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and BareClaw regarding the Service and supersedes all prior agreements and understandings.
